Terms and Conditions of the Progress Your English Online Store

§1 General Provisions

This document specifies the terms and conditions for using the online store available at www.progressyourenglish.com, operated by:

The store sells digital products, specifically e-books, educational games in PDF format, and other English language learning materials.

These terms and conditions are an integral part of the sales agreement concluded with the Customer.

The Customer is obliged to read the terms and conditions before making a purchase.

§2 Definitions

Store – the online store available at www.progressyourenglish.com.

Seller – PROGRESS Szkoła Językowa Karolina Jurkiewicz-Szerner.

Customer – a natural person, legal person, or organizational unit without legal personality, who makes a purchase in the Store.

Consumer – a Customer who is a natural person making a purchase for a purpose not directly related to their
business or professional activity.

Digital Product – digital content in the form of electronic files, especially e-books, educational games, PDF materials.

§3 Technical Requirements

To use the Store and download Digital Products, the following are necessary:

- a device with Internet access,

- a web browser that supports cookies,

- an active email account,

- software that allows opening PDF files.

§4 Placing Orders

Orders can be placed 24 hours a day, 7 days a week.

Purchases can be made without the need to create a user account.

To place an order, the Customer selects the Digital Products they are interested in, adds them to the cart, and then fills out the order form, providing the required data.

After placing an order, the Customer receives an order confirmation at the provided email address, along with payment information.

§5 Payments

The prices of Digital Products are given in Polish Złoty (PLN) and are gross prices.

The Seller is exempt from VAT under Article 113(1) of the Act on Tax on Goods and Services.

Available payment methods:

- Tpay online payment system.

The Customer receives an invoice upon request, after notifying such a need via email.

§6 Delivery of Digital Products

After payment is credited, the Customer receives a link to download the purchased Digital Products at the provided email address.

Delivery of Digital Products occurs immediately after payment is received, no later than within 24 hours.

Digital Products are delivered exclusively electronically.

§7 Right of Withdrawal

In accordance with Article 38(13) of the Consumer Rights Act, the Consumer does not have the right to withdraw from the contract in the case of:

a contract for the supply of digital content not stored on a tangible medium,

if the performance of the service began with the Consumer's express consent before the deadline for withdrawal from the contract,

after being informed by the Seller about the loss of the right to withdraw from the contract.

Before making a purchase, the Customer agrees to the commencement of the service before the deadline for withdrawal from the contract and acknowledges the loss of the right to withdraw from the contract.

§8 Complaints

The Customer has the right to file a complaint if the purchased Digital Product is defective or not as described.

Complaints should be submitted via email to: progress.szkola.jezykowa@gmail.com,
providing:

- first and last name,

- email address used for the purchase,

- order number,

- description of the problem.

The Seller will consider the complaint within 14 days from the date of its receipt and inform the Customer about the outcome of the consideration.

§9 Personal Data

The administrator of Customers' personal data is PROGRESS Szkoła Językowa Karolina Jurkiewicz-Szerner.

Personal data is processed for the purpose of fulfilling orders and for accounting purposes, in accordance with applicable law.

Detailed information regarding the processing of personal data can be found in the Privacy Policy available on the Store's website.

§10 Final Provisions

The Seller reserves the right to introduce changes to the Regulations. Changes are effective from the moment they are published on the Store's website.

In matters not regulated by these Regulations, Polish law shall apply, in particular the Civil Code and the Consumer Rights Act.

The Regulations are effective from May 2, 2025.
